TRADERSCALE – TERMS AND CONDITIONS

User Agreement

1. Parties and Corporate Structure

These Terms and Conditions (“Agreement”) govern the use of services (“Services”) offered under the Traderscale brand by the following group entities (collectively, the “Company”, “we”, “us”, or “our”):

  • Tradelytic FZCO, Dubai Silicon Oasis, DDP Building A1, Dubai, United Arab Emirates

    (Website owner and operator; provider of evaluation and educational services)

  • Traderscale LTD, Nicosia 1065, Cyprus (Company No. HE 461789)

    (Payment processing and merchant services agent)

  • Traderscale Limited, Rodney Bay, Saint Lucia (Company No. 2025-00202)

    (Technology and platform connectivity provider)

The primary website is www.traderscale.com (the “Website”).

2. Acceptance of Agreement

By registering an account, purchasing any evaluation challenge, or using the Services, you (“User”, “Client”, or “Customer”) confirm that you:

  • Have read and understood this Agreement

  • Agree to be legally bound by its terms

  • Enter into this Agreement electronically, which shall have the same legal effect as a signed contract

If you do not agree with these Terms, you must not access or use the Services.

3. Nature of Services 

3.1 Simulation-Only Services

All Services provided by the Company are evaluation, analytical, and educational services only.

  • All trading activity occurs in a simulated / demo environment

  • Any balances, capital, profits, or losses displayed are fictitious

  • No real-market execution occurs

  • No client funds are traded, invested, or managed

3.2 No Investment Services

The Company:

  • Does not provide investment advice

  • Does not offer brokerage or asset-management services

  • Does not accept deposits for investment purposes

  • Does not trade on behalf of users

Nothing on the Website or within the Services constitutes investment advice, a solicitation to invest, or an offer of financial instruments.

4. Eligibility and User Warranties

You confirm and warrant that you:

  • Are at least 18 years old

  • Have full legal capacity to enter this Agreement

  • Are not located in any restricted or sanctioned jurisdiction

  • Are not subject to sanctions, criminal proceedings, or regulatory restrictions

  • Will provide accurate, complete, and up-to-date information

The Company reserves the right to suspend or terminate accounts that breach these warranties.

5. Services Description

The Services include:

  • Paid trading evaluation challenges (“Challenges”)

  • Demo trading tools and simulated accounts

  • Performance analytics and reporting

  • Educational and training materials

  • Client dashboard and account access

Successful completion of an evaluation does not guarantee any future opportunity and creates no entitlement beyond what is explicitly stated in these Terms.

6. Fees, Payments, and Refunds

6.1 Fees

  • Users pay a one-time access fee to participate in an evaluation challenge

  • Fees represent payment for evaluation and educational services

  • Fees are not deposits, investments, or trading capital

6.2 Payment Processing

Payments are processed via authorized third-party payment service providers.

6.3 Refunds

Challenge fees are non-refundable once the challenge has commenced, except where mandatory consumer-protection laws apply.

7. Trading Rules and Prohibited Conduct

Users must comply with all published challenge rules. Prohibited conduct includes, but is not limited to:

  • Market manipulation or abuse

  • Latency or arbitrage exploitation

  • Copy-trading or account mirroring

  • Use of prohibited automated systems

  • Artificial manipulation of evaluation metrics

Violation may result in immediate disqualification without refund.

8. Performance-Based Incentives

8.1 Incentive Nature

Users who successfully meet the published evaluation criteria may become eligible for a performance-based incentive (“Payout”).

Such incentives:

  • Are contractual rewards, not investment returns

  • Are not profit-sharing arrangements

  • Are not derived from user fees or deposits

  • Are funded solely from the Company’s own operating revenues

8.2 No Entitlement or Guarantee

  • Payouts are conditional and discretionary

  • Eligibility is determined strictly in accordance with published challenge rules

  • No user has a guaranteed right to receive a payout

8.3 Payout Processing

Approved payouts are processed via licensed third-party payout service providers selected by the Company.

9. Intellectual Property

All content, software, systems, trademarks, and materials are owned by or licensed to the Company. Users receive a limited, non-transferable licence for personal evaluation use only.

10. Disclaimers and Limitation of Liability

Services are provided “as is” and “as available”.

The Company makes no guarantees of performance, profitability, or success and shall not be liable for indirect, incidental, or consequential losses to the fullest extent permitted by law.

11. Amendments

The Company may amend these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.

12. Governing Law

This Agreement shall be governed by and construed in accordance with applicable laws, without prejudice to mandatory consumer-protection regulations.
